ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE OR PRODUCTS, REGARDLESS OF THE LEGAL THEORY ASSERTED, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN ALL CASES, THE COMPANY’S MAXIMUM LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.

SECTION 9 — RESEARCH USE ONLY (RUO) RESTRICTION

All products sold, distributed, or otherwise provided by Peptotal Peptides are expressly designated and intended solely for laboratory research purposes and in-vitro scientific research conducted by qualified professionals. All products are classified as “Research Use Only” (“RUO”) unless explicitly stated otherwise in writing by Peptotal Peptides.

Under no circumstances shall any products sold by Peptotal Peptides be:

• Used for human consumption;
• Used for medical, diagnostic, therapeutic, or clinical purposes;
• Used in or administered to humans or animals;
• Used in food, drugs, cosmetics, or any household applications; or
• Used in any manner inconsistent with applicable federal, state, or local laws and regulations.

Any prohibited use constitutes a material breach of these Terms and may result in immediate termination of your account and legal action.

SECTION 10 — NO HUMAN CONSUMPTION; NO MEDICAL USE

YOU EXPRESSLY ACKNOWLEDGE, REPRESENT, AND WARRANT THAT ALL PRODUCTS PURCHASED FROM PEPTOTAL PEPTIDES SHALL NOT BE USED FOR HUMAN CONSUMPTION OR ADMINISTRATION.

You further acknowledge and agree that:

• Peptotal Peptides is not a pharmacy, compounding pharmacy, medical provider, or licensed pharmaceutical manufacturer;
• The products sold are not approved by the U.S. Food and Drug Administration (“FDA”) for human or animal consumption;
• The products are not intended to diagnose, treat, cure, or prevent any disease;
• The Company makes no claims regarding medical, therapeutic, or clinical use.

You assume full responsibility for ensuring that products are used exclusively for lawful research purposes.

SECTION 11 — QUALIFIED PURCHASER REPRESENTATION

By purchasing any product from Peptotal Peptides, you represent and warrant that:

1. You are a qualified researcher, laboratory professional, or institution experienced in handling research chemicals;
2. You understand the hazards associated with handling research chemicals and peptides;
3. You possess the necessary training, knowledge, and expertise to safely handle and use the products;
4. You will use all products in compliance with all applicable laws and regulations;
5. You will not resell products for human consumption or medical use.

Peptotal Peptides reserves the absolute right to refuse or cancel any order at its sole discretion if it suspects misuse or unlawful intent.

SECTION 12 — REGULATORY COMPLIANCE

You acknowledge and agree that it is solely your responsibility to ensure compliance with all applicable laws, rules, and regulations governing the purchase, possession, use, storage, import, export, and distribution of any products purchased from Peptotal Peptides.

Peptotal Peptides makes no representation or warranty regarding the legal status of any product in your jurisdiction. You agree that you are solely responsible for determining whether the purchase and possession of any product is lawful in your location.

The Company shall not be liable for any regulatory violations committed by you.

You expressly acknowledge that research chemicals and peptides may present unknown hazards and risks, including but not limited to:

• Toxicity risks
• Health risks
• Handling risks
• Storage risks

You voluntarily assume all risks associated with the purchase, possession, handling, storage, and use of products.

Peptotal Peptides shall have no liability whatsoever for any damages, injuries, or losses resulting from misuse or improper handling.

SECTION 14 — RESEARCH USE ONLY NOTICE AND USE RESTRICTIONS

ALL PRODUCTS SOLD, DISTRIBUTED, OR PROVIDED BY PEPTOTAL PEPTIDES ARE STRICTLY INTENDED FOR RESEARCH USE ONLY AND ARE NOT APPROVED FOR HUMAN OR ANIMAL CONSUMPTION.

FOR RESEARCH USE ONLY. NOT FOR HUMAN CONSUMPTION.

SECTION 15 — LIMITATION OF LIABILITY; MAXIMUM DAMAGES CAP

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PEPTOTAL PEPTIDES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

IN NO EVENT SHALL PEPTOTAL PEPTIDES’ TOTAL LIABILITY EXCEED THE AMOUNT PAID BY YOU FOR THE PRODUCT GIVING RISE TO THE CLAIM.

THIS LIMITATION APPLIES REGARDLESS OF LEGAL THEORY, INCLUDING CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE.

SECTION 16 — INDEMNIFICATION AND DEFENSE

You agree to fully indemnify, defend, and hold harmless Peptotal Peptides, its owners, officers, directors, employees, contractors, affiliates, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses, including attorneys’ fees, arising out of or related to:

• Your misuse of any product;
• Your violation of these Terms;
• Your violation of any law or regulation;
• Your use of products for prohibited purposes.

This obligation survives termination of these Terms.

SECTION 17 — ARBITRATION AGREEMENT (MANDATORY)

ANY DISPUTE ARISING FROM OR RELATED TO THESE TERMS OR THE USE OF THE SERVICE SHALL BE RESOLVED EXCLUSIVELY THROUGH FINAL AND BINDING ARBITRATION.

Arbitration shall be:

• Conducted in the State of Nevada;
• Administered by the American Arbitration Association (AAA);
• Conducted before a single arbitrator;
• Governed by the Federal Arbitration Act.

YOU EXPRESSLY WAIVE YOUR RIGHT TO A TRIAL BY JURY.

SECTION 18 — CLASS ACTION WAIVER

YOU AGREE THAT ANY CLAIM SHALL BE BROUGHT SOLELY IN YOUR INDIVIDUAL CAPACITY.

YOU EXPRESSLY WAIVE ANY RIGHT TO PARTICIPATE IN:

• CLASS ACTION LAWSUITS
• CLASS ARBITRATIONS
• REPRESENTATIVE ACTIONS

No arbitrator shall have authority to certify a class action.

SECTION 19 — ACCOUNT TERMINATION

Peptotal Peptides reserves the absolute right, at its sole discretion, to terminate or suspend your access to the Service immediately and without notice if you violate these Terms or if misuse is suspected.

Termination does not limit the Company’s right to pursue legal remedies.

SECTION 20 — ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and Peptotal Peptides and supersede all prior agreements.

If any provision is found unenforceable, the remaining provisions shall remain in full force.

SECTION 21 — GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Nevada, without regard to conflict of law principles.

You agree that any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts located within the State of Nevada.
